1. General conditions

The Buyer means individual who places an order on the site.
The Site means www.vietcoffee4u.com
The Product means commodity which is published on Site to sell.
The Order means the order submitted by the Buyer to the Site to purchase a product from the Seller.
The Contract means The Buyer orders a product or products in accordance with these terms and conditions.
These Terms and Conditions govern the supply by Seller of any Product ordered by Buyer on Site. By ordering a Product, the Buyer agree to be legally bound by these Terms and Conditions, namely The Seller will sell and The Buyer will buy in accordance with the terms and conditions stipulated below. These terms and conditions shall apply to all Orders and Contracts made or to be made by Seller for the sale and supply of products. When Buyer submit an Order to Seller, give any delivery instruction or accept delivery of the products, this shall in any event constitute your unqualified acceptance of these terms and conditions.
2. The price
The Price of Product doesn’t calculate any VAT, based on the meaning of Value Added Tax Act (VATA) § 19 clause 1 – small business regulation.
The Price of the Product doesn’t include delivery price. Please refer to the clause 4 of current Terms and Conditions.
3. Payment
The Payment shall be made by the Buyer upon placing the Order on the Site

In case the Order is not fully paid, the delivery of the Order will not take place until it’s fully paid.
4. Delivery
Delivery with DHL will be effected within next 2 working days after 100% advance payment will be received by Seller. Accordingly info email will be sent to the Buyer.

* Parcel Type 1 – small, Maxi Envelope with the gross weight up to 1 000g and the maximum size up to 35,3 x 25 x5 cm

**** Parcel Type 5 – XXL parcel with the gross weight between 5 000g and 10 000 g and the maximum size up to 120 x 60 x 60 cm
Please notice, that Delivery outside of Germany can take up to 14 working days (approx. 3 calendar weeks) according to the Terms and Conditions of DHL. Only Parcels Type 3 and 4 can be tracked by the tracking number. For the Parcels Type 1 and 2 the DHL number is for the reference only. For the Parcels Type 3 outside of Germany DHL offers reduced price to the amount in (), however, there will be no tracking number and no insurance.
If you didn’t find your country in the m/a list or your Order is bulky with the weight more then 5 kg, the delivery price will be informed additionally based on the DHL rates, country of destination, the gross weight and the size.
The Buyer can also pick up its Order within Berlin City for free, in the address which will be mutually agreed by the Seller and the Buyer.
The Buyer with delivery destination outside of European Union is responsible to pay required custom duties if any.
5. The right of withdrawal
Buyer has the right to withdraw from this Contract within 14 days without giving any reason.
The withdrawal period will expire after 14 days from the day on which Buyer acquires, or a third party other than the carrier and indicated by you acquires, physical possession of the last good.
To exercise the right of withdrawal, Buyer must inform Seller of its decision to withdraw from this Contract by an unequivocal statement (e.g. a letter sent by post or e-mail). To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Effects of withdrawal
If Buyer withdraws from this Contract, Seller shall reimburse to Buyer all payments received from Buyer, except the costs of delivery if any, without undue delay and in any event not later than 14 days from the day on which Seller informed about Buyer`s decision to withdraw from this contract. Seller will carry out such reimbursement using the same means of payment as Buyer used for the initial transaction, unless Buyer has expressly agreed otherwise. Seller may withhold reimbursement until it has received the Product back or Buyer has supplied evidence of having sent back the goods, whichever is the earliest.
Buyer shall send back the Products or hand them over to Seller, without undue delay and in any event not later than 14 days from the day on which Buyer communicates its withdrawal from this Contract to Seller. The deadline is met if Buyer sends back the goods before the period of 14 days has expired.
6. Severability
If any of these terms should be determined to be illegal, invalid or otherwise unenforceable by reason of the laws of any state or country in which these terms are intended to be effective, then to the extent and within the jurisdiction which that term is illegal, invalid or unenforceable, it shall be severed and deleted and the remaining terms of use shall survive, remain in full force and effect and continue to be binding and enforceable.
